Welcome to DoctorAssist.AI (www.doctorassist.ai), a clinical decision support platform developed and owned by Saraswatha Healthcare and Research Pvt Ltd (“Company,” “we,” “us,” or “our”). By accessing or using our website, platform, or services, you (“User,” “you”) agree to comply with and be legally bound by these Terms and Conditions (“Terms”).

If you do not agree with these Terms, you must not access or use DoctorAssist.AI.

1. Acceptance of Terms

By using DoctorAssist.AI, you acknowledge that you have read, understood, and agree to these Terms, our Privacy Policy, and all other applicable policies, which together govern your use of the platform.

2. Nature of Services

DoctorAssist.AI is an AI-enabled clinical support tool designed exclusively for licensed healthcare professionals, hospitals, and institutions. The platform provides assistance in:

• Clinical documentation support;
• Evidence-based decision support;
• Practice management and workflow optimization;
• Patient engagement and communication tools.

DoctorAssist.AI does not provide a medical diagnosis, prescribe treatment, or replace professional medical judgment. All outputs are intended as supportive guidance and must be reviewed, validated, and actioned only by registered, trained, and licensed clinicians.

3. Eligibility

Our services are intended solely for:

• Licensed and registered healthcare professionals;
• Hospitals, clinics, and healthcare institutions;
• Authorized research or academic institutions.

By using the platform, you represent that you meet these eligibility requirements and are legally authorized to process health data under applicable laws.

4. User Accounts

Some services require account creation. Users agree to:

• Provide accurate, complete, and up-to-date information;
• Maintain the confidentiality of login credentials;
• Accept responsibility for all activities under their account.

We reserve the right to suspend or terminate accounts that provide false information, misuse the service, or violate these Terms.

5. Intellectual Property

All content, trademarks, logos, AI models, software, and technology on DoctorAssist.AI are the exclusive property of Saraswatha Healthcare and Research Pvt Ltd or its licensors.

You may not:

• Copy, reproduce, modify, distribute, or exploit any content without prior written consent;
• Reverse-engineer, decompile, or attempt to extract the source code or models.

6. Medical Disclaimer

The platform is a clinical decision support system (CDSS) only. You acknowledge and agree that:

• Outputs are generated to assist professional judgment, not replace it;
• The platform does not provide a definitive diagnosis or prescribe treatments;
• All final clinical decisions remain the sole responsibility of licensed medical professionals.

Patients must always consult a qualified healthcare provider for diagnosis and treatment. Use of DoctorAssist.AI by non-clinicians or for self-diagnosis is strictly prohibited.

7. Limitation of Liability

To the maximum extent permitted by law, DoctorAssist.AI and its owners shall not be liable for:

• Indirect, incidental, punitive, or consequential damages;
• Loss of data, revenue, or goodwill;
• Clinical or operational decisions made based on platform outputs;
• Errors, omissions, or delays in information provided by third parties.

Our aggregate liability shall not exceed the total subscription or usage fees paid by you in the 12 months prior to the claim.

8. Third-Party Integrations

DoctorAssist.AI may integrate with external services (e.g., labs, imaging, HMS, or cloud providers). We do not control or endorse such third-party services and disclaim liability for their content, availability, or data practices.

9. Data Protection & Privacy

We handle all personal and health data in compliance with global data protection frameworks including HIPAA (USA), GDPR (EU), and DPDP Act (India). Our Privacy Policy explains how data is collected, used, and protected.

We do not sell or misuse your data. All AI models prioritize patient confidentiality, safety, and security.

10. Termination

We reserve the right to suspend or terminate your access at any time, with or without notice, if:

• You breach these Terms;
• You engage in unauthorized, unlawful, or harmful use of the platform.

You may stop using the platform at any time. Certain obligations (e.g., data confidentiality, intellectual property) survive termination.

11. Modifications to Terms

We may amend these Terms from time to time. Material updates will be notified via email or through the platform. Continued use after such changes constitutes acceptance of the revised Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India and, where applicable, by international data protection frameworks. Any disputes shall be subject to the exclusive jurisdiction of the courts of Thrissur, Kerala, unless otherwise required by applicable law.
